CONTRACT CANCELLATION OPTION AGREEMENT - AS REQUIRED BY CALIFORNIA VEHICLE CODE 11713.21
Pursuant to California state law, licensed automobile dealers are required to offer all individuals purchasing (for personal, family, or houshold use) a used automobile that sells for less than $40,000 (high bid) a contract cancellation option agreement. This agreement will allow the buyer to return the vehicle without cause, provided the buyer complies with the following provisions:
Provisions for return of vehicle and cancellation of Contract of Sale
1. The buyer is fully responsible for any loss or damage sustained to the purchased used car under the contract cancellation option.
2. The buyer must return the vehicle, where it was purchased (Selling Dealer's physical location).
3. The buyer understands that they must return the vehicle to the selling Dealer's location no later than the posted close of business within two days from the date of payment in full.
4. There may not be more than 250 additional miles on the odometer from the time of delivery.
5. A written notice exercising the buyer's right to cancel the purchase must be signed by the buyer and submitted at the time of return.
6. The buyer must submit all original receipts of the sale and the original Cancellation Option Contract, given to the buyer at the time of purchase must be submitted at time of return.
7. The buyer must pay a specified restocking fee. The option purchase price will be subtracted from this restocking fee; however, the buyer is responsible for the additional balance.
8. The vehicle must be returned in the same condition, as it was received and free from any additional debt.
TERMS OF SALE
ALL VEHICLES shall be sold AS-IS with NO GUARANTEES or Warranties of any kind unless specifically presented by the selling dealer as having Guarantees or Warranties. It is the buyer's responsibility to preview each vehicle and determine its condition, originality and contents prior to signing purchase documents.
How It Works :: Retail - Dealer to Winning Bidder
Vehicles are offered for sale by dealers in a "Buy It Now", "Timed" or "Live" auction formats. Registered members and Dealers can search, view, and bid on vehicles offered for sale by automotive dealers. All vehicles entered into a BWB Event are dealer's front-line ready inventory.
Once a vehicle is awarded to the highest bidder (buyer), Webentory Inc. will confirm the vehicle's availability with the selling dealer and then notify the buyer. The selling dealer will then contact the buyer within 24 hours to schedule an appointment for delivery at the selling dealer's location. The winning bidder (buyer) should take delivery of the vehicle within 72 hours of the completed event.
Winning bidders (buyers) are encouraged to inspect and test drive the vehicle prior to completing any paperwork at the dealership. Once the winning bidder (buyer) approves of the vehicle, the winning bidder will then complete all the necessary purchase documents at the selling dealer's location.
Winning Bidder's Trade In :: This can sometimes be a touchy situation. With that in mind, we wanted to make sure to include the subject in this section. Winning Bidders are allowed to present a vehicle to trade in on their BWB purchased vehicle. However, if the buyer and the selling dealer are not able to agree on a value, the selling dealer IS NOT obligated to purchase the buyer's trade-in. Furthermore, the trade in value is not a deal-breaker, the Winning Bidder is obligated to purchase the vehicle s/he purchased during the event.
How It Works :: Wholesale - Dealer to Dealer
Vehicles will be offered for sale in a timed auction format. Dealers can view, research, and bid on vehicles offered for sale.
Once a vehicle is awarded to a dealer, Webentory Inc. will confirm the vehicle's availabilty with the selling dealer and then notify the purchasing dealer. Transportation assistance will be offered to purchasing dealer if requested. The cost of transportation will depend on the distance between selling and purchasing dealers.
Upon receipt of the vehicle, the purchasing dealer will inspect the vehicle and verify that the vehicle is as presented, and has no apparent damage or defects.
Vehicle Acceptance :: Dealer to Dealer
Upon acceptance of the purchased vehicle, the following must occur:
- Selling dealer will fax a copy of the clear title and the smog certificate to the purchasing dealer.
- Purchasing dealer will send payment to the selling dealer.
- Upon receipt of payment from purchasing dealer, selling dealer will then send the original
title and a copy of the smog certificate to the purchasing dealer.
- Webentory Inc. will audit transactions to insure process integrity.
